Welcome to Design Dental Lab! These Terms and Conditions govern your access to and use of our services, including but not limited to the design, fabrication, and delivery of dental prosthetics and appliances. By engaging with our services, you agree to comply with and be bound by these Terms and Conditions.
1. Services: Our dental laboratory specializes in the design, fabrication, and customization of dental prosthetics, appliances, and related products. We strive to deliver high-quality products tailored to the specifications provided by dental professionals.
2. Orders and Specifications:
- All orders placed with our laboratory must be accompanied by clear and accurate specifications provided by a licensed dental professional.
- Any changes to specifications must be communicated promptly and may incur additional charges.
- We reserve the right to reject any order that does not meet our standards or legal requirements.
3. Turnaround Time: We make every effort to complete orders within the agreed-upon timeframe. However, unforeseen circumstances may cause delays. We will communicate any delays promptly and work to resolve them efficiently.
4. Quality Assurance: Our laboratory is committed to maintaining the highest standards of quality in our products and services. We carefully inspect all products before delivery to ensure they meet our quality criteria.
5. Payment Terms:
- Payment terms will be outlined in the invoice provided to the dental professional or clinic.
- Payment is due upon receipt of the invoice unless otherwise agreed upon in writing.
- Late payments may be subject to interest charges or collection fees.
6. Shipping and Delivery:
- Shipping costs and delivery times may vary depending on the destination and shipping method chosen.
- We are not responsible for delays or damages incurred during shipping, but we will assist in resolving any issues to the best of our ability.
7. Intellectual Property:
- Any designs, patterns, or other intellectual property provided by the dental professional remain their property.
- All intellectual property provided by Design Dental Lab, including the content and use of this website, remain the property of Design Dental Lab.
- We retain the right to use images or descriptions of completed work for promotional purposes unless otherwise agreed upon in writing.
8. Medical Advice:
- Design Dental Lab will provide goods or services to the dental professional based on instructions provided by them through the prescription form provided.
- The dental professional acknowledges that nothing transmitted in the course of this engagement shall constitute the establishment of a doctor/client-patient relationship between the patient and Design Dental Lab.
- Responsibility for the diagnosis of a medical condition, and for the prescription of treatment planning, material use, or medicines, rests solely with the dental professional.
9. Your Obligations: We are entitled to assume that anyone on behalf of you (including your employees) who places an order with us has full power and authority to do so. You agree to be bound to your obligations regarding the order, irrespective of the nature of the actions of that person.
10 Pricing: Unless specified otherwise, our prices are exclusive of GST or any other taxes. Where GST is applicable, according to the GST Act, A New Tax System (Goods and Services Tax) Act 1999 and any regulations thereunder, the customer must pay the applicable amount of GST in addition to the amount specified for the order.
11 Remakes and warranty:
- Where remakes are required to correct defects arising from errors made by Design Dental Lab, we will gladly rectify the situation reasonably ensuring minimal disruption to, and at no additional cost to the dental professional and their patient limited to the reprovision of the same product or service only by Design Dental Lab.
- Where remakes are desired for matter of preferences that were not previously disclosed in writing to Design Dental Lab, Design Dental Lab will apply a 50% goodwill discount to any remake limited to the reprovision of a similar product or service only by Design Dental Lab.
- Where defects arise in a product or service provided by us in a time frame that is substantially less than what is reasonably expected from any product of similar quality, and the defect is clearly the result of any error made by Design Dental Lab, we will rectify the situation reasonably ensuring minimal disruption to, and at no cost to the dental professional and their patient limited to the reprovision of the same product or service only by Design Dental Lab.
- Where defects arise in a product or service provided by us in a time frame that is substantially less than what is reasonably expected from any product of similar quality, and the cause of the defect is NOT clearly the result of an error made by Design Dental Lab, we will apply a 50% goodwill discount to any remake only by Design Dental Lab.
- Where defects arise in a product or service provided by us that is NOT in a time frame that is substantially less than what is reasonably expected from any product of similar quality, no warranty or goodwill will be offered.
- Defects or missing items from your order must be reported to Design Dental Lab within 1 week of receiving your order or your claim may be limited.
- Warranty claims must be reported to Design Dental Lab within 1 week of you becoming aware of the circumstances leading to the warranty claim or your claim may be limited.
12. Confidentiality: We understand the sensitive nature of patient information and maintain strict confidentiality regarding all aspects of our work, including patient records and treatment plans.
13. Liability:
- Our liability is limited to the cost of the product or service provided.
- We are not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our products or services.
14. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of Queensland. Any disputes arising from these Terms and Conditions shall be resolved through arbitration in the Commonwealth of Australia.
15. Modifications: We reserve the right to modify or update these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website or other communication channels.
